We will make every effort
possible to meet specific deadlines though Barefoot prints makes
absolutely no guarantee on shipping times whether it be
verbal or in writing.
Pricing
Prices are subject to
change without notice.
Packing / Shipping
Prices of all goods do not include any allowances for
special packing/crating/handling or insurance charges.
The Purchaser assumes all responsibility for any
additional shipping charges or expenses that are over
and above the shipping fees that are shown on the
invoice.
Sales and Similar Tax
The prices on this site do not include sales, use,
excise or similar taxes. Consequently, in addition to
the price specified, the amount of any present or future
sales, use excise or similar tax applicable to the sale
of the goods shall be paid by the Purchaser, or in lieu
thereof the Purchaser shall provide the Company with a
tax exemption certificate (resale number) acceptable to
the taxing authorities.
Rejection of Orders
Barefoot Prints has the
right to reject any order at it's sole discretion for
any reason whatsoever and return any prepaid monies back
to the purchaser. Additionally, Barefoot
Prints has the sole discretion to reject any order that
it considers libelous, defamatory, obscene, profane
(according to standards established by the FCC),
portraying irresponsible use of alcohol or other
substances, advocating persecution based on gender, age,
race, disability or national origin, containing explicit
sexual content or is otherwise inappropriate for
Barefoot Prints production. You agree to not use
Barefoot Prints Service to create any material that is
unlawful, harmful, threatening, abusive, harassing,
tortuous, defamatory, vulgar, obscene, libelous,
invasive of another's privacy, hateful, or racially,
ethnically or otherwise objectionable, or that infringes
on any patent, trademark, trade secret, copyright or
other proprietary rights of any third party.
Cancellations / Returns / RefundsContracts or orders may not be cancelled, voided or returned
for any reason. Barefoot Prints does not refund monies
on any items that have been screen printed. In the event that a
return or replacement is authorized by Barefoot Prints
in it's sole discretion, the customer accepts
full responsibility for any charges that are incurred to
include shipping. It is the purchasers
responsibility to ensure the order is complete at the
time of pick-up or delivery. Barefoot Prints uses
a double count sign-off sheet to ensure orders are
complete and accurate.
Attorney's Fees
If any action at law or
in equity, including an action for declaratory relief,
is brought to enforce or interpret the provisions of
this agreement, the prevailing party shall be entitled
to reasonable attorney fees, which may be set by the
court in the same action or in a separate action for
that purpose, in addition to court cost and any other
relief to which the prevailing party may be entitled.
Indemnity
You
agree to defend, indemnify and hold Barefoot Prints and
its affiliates harmless from and against any and all
claims, damages, costs and expenses, including
reasonable attorneys' fees, arising from or relating to
your use of Barefoot Prints Site and any and all
services provided, your violation of this Agreement, or
your violation of any rights of another.
